Justice prevails:
P.T. Ummer Koya loses Court case again. His application dismissed in his
property attachment case.
As you all know, AICF filed a suit to recover Rs 1,11,12,831.00 together
with interest at 12% per annum, from P.T.Ummer Koya & six others and
obtained an interim injunction order restraining Ummer Koya from
alienating his properties. Against this P.T.Ummer Koya filed an appeal to
revoke the leave granted to sue and another application to reject the
plaint.
The Madras High Court after considering the issue on merits, dismissed his
application for revocation of leave, A.No 4472 and 6851 of 2007. The
application for rejection of plaint,A.No.6852, was also dismissed.
On the Application for injunction and attachment preferred by the AICF,
the Court ordered as follows:
a ) The defendants shall furnish security to the extent of the suit claim, in the form of immovable property or
Bank deposits or Bank Guarantee within a period of four weeks
from today.
b) Till such time, there shall be an interim injunction, as prayed
for in O.A.No 567 of 2007
c) If the defendants fail to furnish security within the
period stipulated, as per claim a) above, there will be
automatically an order of attachment of the properties described in
the schedule to the Judges summons in A.No 3668 of 2007.
